These terms are an agreement between you and The Wizard Limited, a company registered in New Zealand (company number 5842171, NZBN 9429042055051), which operates Hexis ("Hexis", "we", "us"). They cover the website at myhexis.app and the app at app.myhexis.app.
By creating an account or using Hexis, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Hexis.
1. What Hexis is
Hexis is software for tracking health protocols and blood-test results. It lets you record what you take, see estimated levels over time, store your lab results, and share reports.
Hexis is a tracking tool. We don't sell, supply, prescribe or recommend any medication, hormone, peptide, supplement or other substance.
2. Not medical advice
Hexis does not provide medical advice, diagnosis or treatment. Please read this section carefully.
- Estimated levels are estimates. The curves Hexis draws come from a mathematical model based on published averages. Real levels vary widely between people, and only a blood test shows what's actually in your body.
- Reference ranges and flags are information, not a diagnosis. A result inside a range isn't proof that you're healthy, and a result outside one isn't proof that you're not.
- Nothing in Hexis tells you what to take, how much, or when.
- Talk to a qualified health professional before starting, stopping or changing anything, and about what your results mean for you.
- In an emergency, contact emergency services — not Hexis.
You're responsible for the decisions you make about your health.
3. Who can use Hexis
You must be 18 or older and able to enter into a binding agreement. If you use Hexis on behalf of a business, you confirm you're authorised to accept these terms for it.
4. Your responsibilities
- Follow the law where you live. The rules about many substances differ between countries. Recording something in Hexis doesn't mean it's legal for you to possess or use, and you're responsible for complying with the laws that apply to you.
- Keep your information accurate. Hexis's calculations are only as good as what you enter.
- Keep your login safe. Don't share your password, and tell us at contact@myhexis.app if you think someone else has accessed your account. You're responsible for what happens in your account.
- Only enter information about other people with their permission.
5. Coaches and clients
If you use Hexis to work with clients:
- You must have each client's permission before entering information about them or inviting them.
- You're responsible for your own coaching — the advice you give, your qualifications, your prices and how you run your business, and for complying with any professional rules or laws that apply to you. Hexis isn't a party to your relationship with your clients and doesn't supervise it.
- Clients own their data. When you give a client their own login and they confirm their email address, the record you've built for them moves into their account and becomes theirs. You keep access only as long as they allow it, at the level they choose. They can pause or end your access at any time, and you can't delete their account or data.
If you're a client, your coach's advice comes from your coach, not from Hexis.
6. Sharing reports
You can create links that let someone — such as your doctor — see a report of your results. Anyone with the link can see what it includes until it expires (at most 90 days after you create it) or you revoke it, so only send it to people you trust.
7. Plans and payment
Plans. Hexis has a free plan and paid plans. What each includes, and current prices, are shown in the app under Settings → Plan and at checkout.
Billing. Paid plans are billed in advance in US dollars, monthly or yearly, and renew automatically until you cancel. Payments are processed by Stripe. Prices don't include any taxes that may apply where you live.
Cancelling. You can cancel at any time from Settings → Manage billing. Your paid plan continues until the end of the period you've already paid for, then moves to the free plan. You can resume before then.
Refunds. We don't give refunds for partial periods, except where the law requires it — this doesn't affect your rights under the Consumer Guarantees Act or the equivalent law where you live. If we shut Hexis down, we refund the time you've paid for but won't receive (see section 12).
Changing plans. You can switch plans from Settings → Manage billing. If you switch part-way through a period, the difference is worked out automatically and shown before you confirm.
Price changes. If we change the price of your plan, we'll tell you at least 30 days beforehand. The new price applies from your next renewal, and you can cancel before then.
Failed payments. If a payment fails, our payment provider tries again over the following days and your plan carries on meanwhile. If it still isn't resolved, your account moves to the free plan.
Discounts. Promotional or founding-member discounts apply as described when they're offered, and can't be exchanged for cash.
8. Your data when your plan changes
We never delete your data because you downgraded, cancelled or a payment failed. Anything beyond the free plan's limits becomes read-only — still there, still visible — until you upgrade again. Export is available on every plan, always.
9. Your content
Everything you enter into Hexis remains yours. You give us permission to store, process and display it only so we can run Hexis for you and the people you choose to share it with. That permission ends when you delete the content or your account, apart from short-term backups that are replaced automatically.
If you send us feedback or ideas, we may use them to improve Hexis without owing you anything for it.
10. Things you mustn't do
Don't:
- use Hexis for anything illegal, or to help anyone else break the law
- enter information about someone without their permission
- try to access accounts or data that aren't yours
- probe, scan or test Hexis's security without our written permission
- copy, scrape, resell or reverse-engineer Hexis
- overload, disrupt or interfere with the service
- use Hexis to send spam or harmful content
11. The service
We work hard to keep Hexis reliable, but we can't promise it will always be available or error-free. We may improve, change or remove features over time. Keeping your own copy with the export in Settings is a good habit.
12. Ending the agreement
You can stop using Hexis and delete your account at any time from Settings.
We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to by law. Unless it's unlawful or would cause harm, we'll tell you first and give you a chance to export your data.
If we ever decide to shut Hexis down, we'll give you at least 30 days' notice so you can export your data, and refund any time you've paid for but won't receive.
13. Disclaimers
Except as stated in these terms, Hexis is provided "as is". To the extent the law allows, we don't give any other promises — for example, that Hexis will suit a particular purpose, or that its calculations will match your actual blood levels.
14. Limits on our liability
To the extent the law allows:
- we aren't liable for indirect or consequential losses, such as lost profits or lost data that you could have exported; and
- our total liability to you for any claim related to Hexis is limited to the greater of US$100 or the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that can't be limited by law, including for fraud, or for death or personal injury caused by our negligence.
15. Consumer rights
Nothing in these terms takes away rights you have under consumer protection laws that can't be excluded.
If you're in New Zealand and use Hexis for a business purpose — for example, as a coach — you agree that the Consumer Guarantees Act 1993 doesn't apply, to the extent the law allows.
16. Law and disputes
These terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction. If you're a consumer and the law where you live gives you the right to bring a claim in your own country's courts or under its laws, that right isn't affected.
If something goes wrong, please contact us first at contact@myhexis.app — most problems can be sorted out quickly.
17. Changes to these terms
We may update these terms. If we make a significant change, we'll tell you by email or in the app at least 14 days before it takes effect. If you keep using Hexis after that, the new terms apply; if you don't agree, you can cancel and export your data.
